Minutes of the April 2016 Supervisors' Meeting

 

April 4, 2016

Francis Fruehan called the meeting to order at 7:00 PM and called for a salute to the Flag.

The minutes from the March meeting were read and approved with corrections regarding bidded material on a motion made by Evan Everitt and seconded by Butch DeLousia, all approved.

The Treasurer report was read, approved and held for audit on a motion made by Evan Everitt and seconded by Butch DeLousia, all approved.

Evan Everitt gave the bid results from the equipment posted on Auctions International. The high bid for the BMY 5- Ton Dumptruck was $10,200. Evan Everitt made a motion to accept the bid, Butch DeLouisa seconded, all approved. The high bid for the 45,000 Hydraulic Winch was $1,500. Evan Everitt made a motion to accept the bid, Butch DeLousia seconded, all approved.

Sluice pipes:

Bradco Supply was the only bid received.

Stone:

All bids accepted - depending on the work site will determine the quarry where the stone will be purchased from. Hourly triaxle – Stoney Mountain was the only bid received. Evan Everitt made a motion to accept the bids as noted, Butch DeLousia seconded, all approved.

No fuel bids received. Evan Everitt made a motion to advertise for the fuels – unleaded gas, biodiesel and heating oil as well as flake calcium in the 2,000 Lb. sacks for dust control, Butch DeLousia seconded, all approved.

Levi Tiffany has submitted his resignation as a part-time police officer effective April 10, 2016. Francis Fruehan made a motion to accept Levi Tiffany’s resignation, Butch DeLousia seconded, all approved.

A letter has been received from Montrose Borough requesting Fire Police services to assist with traffic control for the Memorial Day Parade and July 4th Parade. Francis Fruehan made a motion to approve the Fire Police to assist as requested per the letter received, Evan Everitt seconded.

Evan Everitt has received a quote from a local contractor for the repair/replacement for the man door in the garage. The existing door is rusted through and a new door and frame is needed. The township will purchase supplies needed. The quote received is for $35/hour and should not exceed $400 for the labor. Francis Fruehan asked if anyone had questions. Evan Everitt made a motion to accept the bid from Mike’s Home Improvement at an hourly rate of $35 for the repair, Butch DeLousia seconded, all approved.

Francis Fruehan announced that the Board of Supervisors met in Executive Session from approximately 11 am to 12 noon on March 31, 2016 to discuss potential litigation with regard to contracts for uniform rentals and supplies with the township’s Solicitor.

Francis Fruehan made a motion to meet in Executive Session to discuss solicitor’s letter to the Supervisors regarding the same issue at 7:45 pm. Evan Everitt seconded and all approved.

Francis Fruehan reconvened the meeting at 8:20 pm.

Following the Executive Session Francis Fruehan made a motion authorizing the Secretary to send a letter on behalf of the Township Supervisors to Cintas stating that we received their letter dated March 28, 2016 and that it is under review by the township’s Solicitor. In the meantime, any payments made by the township are made under protest and without prejudice, Evan Everitt seconded, all approved.

Francis Fruehan made a motion to pay invoices submitted by Cintas in the amounts of $214.09 and $123.79 and it will be noted that these payments are made under protest and without prejudice, Butch DeLousia seconded, all approved.

Francis Fruehan announced that UniFirst is alleging a five-year contract with township for uniforms and cleaning materials. None of township supervisor had been aware of the contract, seen the contract or authorized anyone to sign it.

Francis Fruehan made a motion to reject the alleged UniFirst contract as it was not approved by the Board of Supervisors and to also authorize the Solicitor to notify UniFirst of the Township’s position and to offer payment for materials received to settle the matter. Evan Everitt seconded, all approved

Francis Fruehan read the police report with 21 incidents for the month of March. The report will be posted on the bulletin board following the meeting. The report will also run in the local newspapers.

Evan Everitt gave the road report – back to plowing snow. A grant application for a Dirt/Gravel Road Project for Snow Hollow Road will be submitted.

Assessment permits – None

Driveway permits – None

Evan Everitt made a motion to pay the bills as submitted including Cintas as previously discussed, with the exception of the bills submitted by UniFirst, Butch DeLousia seconded, all approved.

As no further business was received, Evan Everitt made a motion to adjourn the meeting, Francis Fruehan seconded, all approved.
